Seashells Swim School Terms and Conditions
It is the responsibility of the Parent / Guardian who has filled in the Booking / Re-enrolment form to ensure that the person who accompanies their child/children to the lessons is made fully aware of Seashells Swim Schools Term and Conditions including our pool rules.
By booking and attending lessons the parent / guardian agrees to commit to the full swim term and to the terms set out below as well as the Seashells Swim School pool rules.
All clients are expected to abide by the terms and conditions & pool rules. In the unlikely event of failure to do so, a customer may be requested not to continue lessons with Seashells Swim School. A refund will not be provided in these circumstances. Clients are responsible for their children at all times (except during a lesson in the pool where the child is NOT accompanied by an adult or carer) and must inform Hannah Tulley prior to the lesson of any concerns they have.
Re-enrolment
Swimmers already having lessons with Seashells Swim School will have priority booking for the following term if they re-book and pay on time. If we do not receive your payment by the requested due date, then your child's place can be allocated to another person. If you have a day/time change request, please write this on your re-enrolment form - we will then get back to you with possible spaces once all re-enrolments are in. Re-bookings are normally done towards the end of the term. All other places are booked on a first come, first served basis. Seashells Swim School will endeavour to be flexible in its allocation of time slots. However, it may not always be possible to book or re-book your child's first choice. The group that the child is placed in will be at the teacher/swim school’s discretion based on their professional opinion. Payment is due before the start of any lessons. Failure to pay will mean you are not able to swim, due to the terms and conditions put on us by our own insurance provider. Term dates are detailed on the confirmation email.
Lesson Fees

All fees must be paid in advance of the start date of the course per the invoices issued.

Swimmers will not be allowed to participate in any swimming lessons until the outstanding fees are paid in full.

All payments to be made preferably by BACS transfer or Monthly DD. Alternatively cash or cheque payment will also be accepted. (Cheques payable to Hannah Tulley).

Any bank charges we receive for returned cheque payments will be subject to an administration charge of £10.00.

Seashells Swim School do not offer refunds or ‘catch-up-lessons’ for lessons missed or for removal of children from the swim school.

Seashells Swim School terms are between 11 - 14 weeks in duration, this will be specified at time of re-enrolments. When a class is booked, the invoiced payment is requested to secure the place for the new term. Classes may be joined at ANY point in the term (and clients pay for the classes remaining).

Sibling discounts: all additional siblings will receive their first lesson of the term free of charge; this discount will be applied in advance and invoiced accordingly.

The re-enrolment letter will advise the client of any credits outstanding from the previous term which they can deduct from their next term’s payment. If they are not returning they can, at this stage, request a refund which will be issued after the end of their current term. If a lesson is cancelled part way through, the client will only be credited if they were in attendance, and for the part of the lesson that had to be cancelled, on a pro-rata basis.
Credits & Refunds
We are unable to refund, credit or replace missed lessons that may occur due to sickness; school, work or social commitments; transport difficulties; bereavements or holidays as the lessons are planned in advance and the payment secures the place for the full term. In the case of serious illness or injury (i.e. a broken limb) each case will be considered individually, and in exceptional circumstances the client may be given the option of carrying lessons over to a later date (e.g. credits for Splash Courses during school holidays).
No refunds will be offered in the case of exceptional circumstances outside the control of Seashells Swim School. (ie: weather conditions / traffic works/delays )
Holidays - if you wish to take a holiday during the term, you will still be charged for the full term. You will of course retain your place on the course for that term.
Notice Period
If you wish to leave the lessons part way through the term we will require 4 weeks notice, after which we will refund you any lessons that you have paid for that your child/children will not be taking part in. We will not refund you without the notice period.
If your child injures themselves and you have to place their lessons on hold, ie: broken arm you will be charged for the lessons moving forward If you wish for us to continue to hold your child’s place in the term, the other option is to receive a refund for lessons your child can not attend due to their injury, we will place you on the waiting list and let you know when a suitable space becomes available.
Lesson Changes
If Seashells Swim School need to change lessons in the event of an instructor being absent for a group or a private lesson, the swim school are within their rights to change the instructor to make sure that the lesson is covered and no refunds will be given for lessons because of a change of instructor. In the unlikely event of “last minute” lesson time change, the client will be notified by Seashells Swim School by text message to their mobile phone, with as much notice as possible. In the unlikely event of lesson cancellations by Seashells Swim School the lesson fee will be credited against the following term’s fees or alternatively refunded at the end of the current term.
Medical & Learning Conditions
Clients must declare to Seashells Swim School any existing medical conditions or learning difficulties that they are aware of that the child, or adult (if taking lessons) has which may be infectious or possibly be harmful to another person or that could affect the child’s progress in the lesson. The client must agree to inform Seashells Swim School of any changes in any medical condition as soon as they are aware of them. All information will be kept strictly confidential and it is at Seashells Swim School’s discretion to accept or refuse any applicant to join in classes.
When you receive our terms & conditions, you take responsibility for the fact that, should you answer ‘yes’ regarding any medical conditions you or your child might have, you’ve checked things out with your doctor before starting with us. This responsibility is passed on to any other parent or carer who might bring your child swimming.
If your child has a heavy cold, sinusitis or an ear infection we recommend they do not swim.
Following on from sickness we request your child be clear of any symptoms for 48 hours prior to attendance at class. In the instance of vomiting and diarrhea the child must have been clear of all symptoms for at least 48 hours before attending a lesson.
If the swimmer contracts chicken pox they are not allowed to return to lessons until all the sores have fully dried out and scabbed over. If your child arrives with sores not fully healed Seashells Swim School are within their right to request the swimmer not take part in the lesson.
If a swimmer has broken a limb, requires an operation or has been given a medical reason why they cannot attend the remaining lessons, then we will consider transferring the lessons to the next term, or offering extra lessons if we can accommodate this. This is subject to a doctor’s note being received. Only the number of weeks remaining from the term will be held and carried over and the weeks cannot be backdated for missed lessons.
Personal Information
Seashells Swim School do not store or record any information about client’s bank accounts or credit cards. We only use the supplied contact details when corresponding on matters regarding the child’s swimming lessons. We do not sell or pass on any clients information to third parties.
Lost Property
All property left in changing rooms or on poolside, and all property (including prams) left in reception or outside, is left entirely at the client’s own risk. Seashells Swim School cannot accept any responsibility for the loss of or damage to any personal possessions.
Lost property found at the pool will be kept for a period of 6 weeks, and if not claimed, may be disposed of.
With the above in mind, please ensure that no valuable items are brought to the swimming lessons.
Welfare
All users of Seashells Swim school are to make themselves familiar with the pool’s rules. These are displayed at the pool.
Abuse to any member of staff either verbal or physical will not be tolerated and will be reported to the appropriate authorities at the sole discretion of Seashells Swim School. Clients must adhere to the instructions given to them regarding car parking, entry and exit route to the pool. Seashells Swim School cannot be held responsible for any consequential loss or damage to a client’s vehicle or property whilst in the pool’s grounds.
Parents/guardians are responsible for their children at all times in the changing area and entrance area. They should always be under the direct supervision of an adult who is not taking part in the lesson and never be left unattended. Children running on wet surfaces can very easily slip and hurt themselves. Children are not Seashells Swimming School’s responsibility until the instructor takes them.
Parents should remain in the pool building when their child/ren is/are swimming.
Seashells Swim School cannot be held responsible for any personal injury or fatality that may occur.
The recommendations, ideas and techniques expressed and described in Seashells Swim School classes, cannot be regarded as a substitute for the advice of qualified medical practitioners. Any uses to which the recommendations, ideas and techniques are solely at your discretion.
Food and Drink is not permitted on poolside at any time. Shoes must also be removed before entering the poolside or overshoes worn (supplied in reception). In the unlikely event that there are no overshoes, then shoes must be taken off before going up to poolside.
Smoking is strictly forbidden within our facility.
Photography
Please note that due to child protection regulations, photography (including camera phones) and video filming are NOT permitted during Seashells Swim School lessons or photo sessions arranged by Seashells Swim School.
If you wish to take photos, please ask Hannah Tulley for permission prior to the lesson where it may be possible to take some photos at the end of the session, or other swimmers can be made aware and we can make sure that everyone is happy. In this instance the photos can only be of your child.
Seashells Swim School cannot be held liable for the actions of third parties and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of this section headed “Photography” by any party.
Videos and photography of the lessons or in the changing area or other communal area is strictly forbidden.
Hygiene
All swimmers should be encouraged to blow their noses and to go to the toilet before they enter the water as this helps to keep the pool clean and maximises their learning time.
Do not take any food or drink up onto poolside. You are welcome to feed your children in reception.
No buggies in the changing rooms or up on poolside, please leave them downstairs in reception, this is for hygiene reasons.
Any parents or carers using the toys, play pen or change tables provided, do so at their own risk.
Pool Safety
In the event of any emergency the person in charge will follow the pool's emergency action plan (EAP). All swimmers and spectators will immediately stop what they are doing and wait quietly for further instructions.
Should it be necessary to clear the pool, when the instruction is given, all swimmers will move to the sides of the pool, leave the water and stand back from the side. Should it be necessary to evacuate the building no attempt should be made to recover possessions from the changing rooms or anywhere else within the building.
Leaving Children Unaccompanied: Parents/guardians must always be present in the building in case of an emergency and must be on poolside to collect them at the end of their lesson and in an event of an emergency.
Withdrawal of service
Seashells Swim School at its own discretion, may refuse entry to a client to its lessons if it is felt that the client’s behavior is in any way disruptive or unreasonable.
Behaviour
Speaking with the teachers: please do not interrupt teachers during their lessons. If you have a general enquiry, please email us at info@seashellsswimschool.co.uk. Or leave a message in the message book on reception.
In the event of a swimmer, parent, guardian, sibling or other associate refusing to obey an instruction from a member of staff, behaving in an unruly manner towards a member of staff or any other person, or causing damage to pool premises or any of the furniture fixtures or equipment in those premises, the swimmer shall not be permitted to continue with the lesson. In light of the above action Seashells Swim School shall then have the right to terminate the contract without further notice and without being required to offer any credit or refund to the swimmer and the swimmer shall not be accepted for any future course organised by the company.
Changes to Terms and Conditions
From time to time Seashells Swim School may update these terms & conditions by sending you either an updated version or notification of minor changes. You are free to not accept these changes but we would ask you to notify us in writing of your non-acceptance within 14 days of receipt, failing which we will be entitled to treat our agreement with you as being subject to the updated version.
